Amazon face lawsuit from Apple over App Store name

Amazon face lawsuit from Apple over App Store name Amazon is facing a lawsuit from Apple over its use of the name 'Appstore' for its mobile software developer programme, which operates in a similar manner to Apple's own App Store, only with the former store featuring downloadable applications for the Android operating system.

Apple claims the name Appstore is deliberately similar to its own App Store, which offers apps exclusively for iOS mobile products. According to Cupertino, it has contacted Amazon three times already demanding the online marketplace cease and desist using the name.

The BBC quote the lawsuit as saying: "Amazon has begun improperly using Apple's App Store mark in connection with Amazon's mobile software developer program."

"Consumers of mobile software downloads are likely to be confused as to whether Amazon's mobile software download service is sponsored or approved by Apple."

Amazon's store launched in the United States Tuesday and will offer exclusive apps from developers, including Angry Birds Rio, a sequel to massively successful mobile game.

Acceptance of their products into the store is very profitable for developers as they will be given access to Amazon's customer base of tens of millions. The association with a trusted brand will also increase an app market position as the demand for apps increase.

Apple has applied to have 'App Store' registered as a trademark in the United States; however, the trademark trial and appeals board have yet to make a decision on if it will be granted.
